These Terms of Service ("Terms") govern your use of GST Cranes, including gstcranes.com, and the services offered by GST Cranes ("GST Cranes", "we", "our", "us").
1. Acceptance of Terms
By creating an account or using our services, you agree to these Terms. If you don't agree, don't use the service.
2. Service Description
GST Cranes is a B2B software platform for the global crane industry. It provides:
- A crane company and fleet directory used to discover market supply and business contacts
- AI-assisted marketplace listing tools to buy and sell used cranes and post wanted ads — we charge 0% commission on the B2B crane deal itself
- Paid digital promotion services for crane sellers and buyers
- Pro Dealer subscription for verified businesses
Our role (intermediary): for crane buy/sell listings we operate an online intermediation service that hosts third-party listings and connects business buyers and sellers. We are not a party to, and take no commission on, the resulting equipment transaction — that contract is solely between the buyer and the seller.
Listing ranking & paid placement (EU P2B Regulation 2019/1150): by default, listings are ranked by relevance to the search/query, recency, and completeness of specs. Paid placement affects ranking — Pro Dealer subscribers receive priority placement, and an "AI Search Boost" can be purchased to rank a listing higher in our AI agent results. Paid or boosted placements are identified as such. No payment to us guarantees a sale.
3. Eligibility
You must be 18+ and represent a legitimate business. Individual consumers are not the target audience.

5. Payments
Payments are prepared for secure hosted checkout. While test mode is active, no payment is taken; confirming a checkout records the order for GST review, no card or payment method is charged, and no billing document is issued. Once live billing starts, the payment provider handles card processing and GST Cranes never receives your full card details. All prices are in EUR unless stated otherwise.
6. Pro Dealer Subscription
- Price: €150 per month, billed monthly in advance
- Auto-renewal: Subscriptions renew automatically each month until cancelled
- Cancellation: You can cancel anytime from your account dashboard. Cancellation takes effect at the end of your current billing period (no proration)
- EU 14-day cooling-off: EU consumers have 14 days from initial subscription to request a full refund (per EU Consumer Rights Directive)

9. Acceptable Use
You may NOT use our services to:
- Post fraudulent or misleading listings
- Send spam or unsolicited communications via our platform
- Scrape, harvest, or extract data without authorization
- Reverse engineer or interfere with the platform
- Violate any applicable law
We may suspend or terminate accounts that violate these rules.
Reporting illegal or infringing listings (EU Digital Services Act): anyone can report a listing they believe is illegal, fraudulent, or infringing by emailing [email protected] with the listing URL and reason. We review notices promptly, act where justified, and inform the reporter and the affected seller of our decision and the reasons for it.
Business sellers (trader identity): sellers using the marketplace act as businesses (traders) and must provide accurate identifying information (legal name, address, contact, and registration/VAT details where applicable). We may suspend listings where this information is missing or unverifiable.
Sanctions, export control and prohibited use: GST Cranes sells software, marketplace access and digital promotion services; it does not sell, broker, finance or ship the crane equipment itself. You may not use the service for sanctioned parties or territories, illegal military or weapons end use, export-controlled transactions without required permits, fraud, money laundering or any transaction that a payment provider prohibits.
10. User Content
You retain ownership of content you submit (listings, photos, descriptions). You grant us a worldwide, non-exclusive, royalty-free license to display, distribute, and promote your content on our platform and related marketing channels.
11. Intellectual Property
The "GST Cranes" name, logo, and platform design are our intellectual property. Don't copy, modify, or use them without permission.
12. Service Availability
We aim for high availability but do not guarantee 100% uptime. Scheduled maintenance and unforeseen outages may occur.
13. Disclaimer of Warranties
The service is provided "as is" without warranties of any kind. We do not verify the accuracy of all directory listings — these are user-submitted or compiled from public sources.
14. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
15. Indemnification
You agree to indemnify us against claims arising from your use of the service or violation of these Terms.
16. Termination
We may suspend or terminate your account for ToS violations. You may close your account anytime. Sections that should survive termination (IP, liability, governing law) do.
17. Governing Law
These Terms are governed by the law and jurisdiction stated in the applicable invoice, order form or company disclosure. Mandatory consumer, data-protection and platform rights in the EU, UK and US remain unaffected.
18. Changes
We may update these Terms. Material changes are communicated via email and a notice on the site, with at least 30 days' advance notice.
